Terms & Conditions

These Terms and Conditions ("Terms") are entered into by and between you ("User", "Client", "Architect", or "You") and Trigunatmika Atelierr Pvt. Ltd. ("Trigunatmika", "Company", "we", "us", or "our"), an architectural and design private limited company registered in India with its corporate office at Urban Square Mall, 4th Floor, Office No.- 404, Gaurav Path, Udyog Vihar, RIICO Industrial Area, Sukher, Udaipur, Rajasthan 313001, India.

These Terms govern your use of the Trigunatmika mobile application (available on Google Play Store and Apple App Store) and any associated online portals or communication channels (collectively, the "Platform").

By installing, creating an account, or interacting with the Platform, you certify that you have read, understood, and unconditionally accept all terms and conditions set forth herein, as well as our Privacy Policy.

The Trigunatmika Platform is a proprietary, private business tool tailored specifically for studio clients, assigned architectural consultants, and authorized site coordinators.

• Age Requirement: You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872. The Platform is not intended for minors.
• Activation Code Requirement: Account creation requires an official studio activation or project invitation code provided exclusively by Trigunatmika Atelierr Pvt. Ltd. You may not share, sell, or distribute this activation code to unauthorized third parties.
• Account Accuracy: You agree to provide true, accurate, current, and complete information during registration and to maintain and promptly update your profile.
• Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials (username and password) and for all activities that occur under your account. You must notify us immediately of any unauthorized breach or suspicious activity.

The Platform provides a collaborative workspace designed to streamline architectural, interior, landscape, and project execution workflows:

• Access to project files, 2D architectural drawings, 3D renderings, and revision histories.
• Logging, reviewing, and geo-verifying site visits and site marking requests.
• Direct collaboration and messaging between verified clients and assigned studio architects.
• Visibility into project stage milestones, construction status, and payment progress records.

All content, designs, concepts, drawings, sketches, floor plans, 3D models, photographs, graphics, text, logos, trademarks, software code, and user interface elements provided through the Platform are the exclusive intellectual property of Trigunatmika Atelierr Pvt. Ltd. and are protected under Indian and international copyright, trademark, and design patent laws.

Limited License to Clients

Subject to full compliance with your primary architectural agreement and these Terms, Trigunatmika grants authenticated clients a limited, non-exclusive, non-transferable, revocable license to access, view, and download project drawings solely for the purpose of executing the specific physical architectural or interior project commissioned with the studio.

Prohibited Actions

• You may not reproduce, duplicate, copy, sell, trade, or distribute any architectural plans or designs created by Trigunatmika for any project or site other than the contracted property.
• You may not reverse-engineer, decompile, disassemble, or extract source code from the mobile application.
• You may not remove, alter, or obscure any proprietary copyright notices, watermarks, or studio logos affixed to drawings or documents.

You may upload site photos, notes, specifications, drawing revision requests, and messages ("User Content") through the App.

• Ownership & Responsibility: You retain ownership of materials you upload, but you grant Trigunatmika Atelierr Pvt. Ltd. a non-exclusive license to use, display, and process your submissions for the purpose of executing your project.
• Warranty: You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to submit any content, images, or documents you provide.
• Prohibited Content: You agree not to upload any content that is unlawful, defamatory, harassing, obscene, infringing on third-party intellectual property, or containing malware, viruses, or harmful code.

The in-app chat and messaging facilities are provided solely for professional project collaboration.

• Project conversations are accessible to the verified client, assigned architects/engineers, and studio administrative staff.
• Trigunatmika studio administrators reserve the right to review, moderate, edit, or remove chat messages, drawing notes, or attachments that are erroneous, abusive, redundant, or inconsistent with professional project records.
• Official instructions that modify contract scope, budget, or architectural layout must be confirmed through formal documentation as required by the studio's primary agreement.

Certain functions of the App require access to device hardware capabilities:

• Camera & Media: Used for capturing on-site progress photos and uploading reference blueprints.
• Location: Used in the foreground exclusively when logging a site visit or site marking request to record verified on-site coordinates.
• Notifications: Used to deliver alerts on drawing releases, milestone approvals, and urgent studio communications.

While Trigunatmika Atelierr Pvt. Ltd. makes every reasonable effort to ensure uninterrupted availability of the Platform, we do not guarantee that the App will be free from temporary downtime, maintenance interruptions, or telecom connectivity delays.

The Platform may display project milestone stages, payment schedules, and status indicators (e.g., Pending, Received, Overdue) for project transparency and record-keeping.

• All financial obligations, payment milestones, fees, applicable taxes (such as GST), and terms of payment are governed strictly by the primary architectural contract executed between the client and Trigunatmika Atelierr Pvt. Ltd.
• Information shown in the App does not constitute a bank statement or a negotiable instrument. Formal tax invoices are issued directly by Trigunatmika Atelierr Pvt. Ltd.

Both parties acknowledge that through the use of the Platform, they may have access to confidential information, including proprietary architectural designs, floor layouts, material specifications, fee structures, and private client property details.

You agree to maintain strict confidentiality of all studio blueprints, design drafts, and project communications, and not to disclose such proprietary information to any competitor, public forum, or unauthorized third party without prior written authorization from Trigunatmika Atelierr Pvt. Ltd.

We reserve the right, at our sole discretion, to suspend or terminate your account and revoke access to the Platform immediately, without prior notice or liability, in the event that:

• You breach any provision of these Terms or the Privacy Policy.
• You attempt unauthorized access to other projects, reverse-engineer the App, or disrupt studio operations.
• Your formal client architectural engagement or employment/contract with Trigunatmika is terminated or concluded.

You may request deletion of your account at any time as detailed in Section 8 of our Privacy Policy.

THE PLATFORM AND ALL CONTENT, DRAWINGS, MATERIALS, AND SERVICES INCLUDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TRIGUNATMIKA ATELIERR PVT. LTD. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE PROMPTLY CORRECTED.

ACTUAL PHYSICAL CONSTRUCTION WORK, STRUCTURAL INTEGRITY, LOCAL MUNICIPAL BY-LAWS, AND SITE SOIL CONDITIONS ARE GOVERNED BY ON-SITE AUDITS AND FORMAL CONTRACTUAL SPECIFICATIONS, NOT DIGITAL IN-APP MOCKUPS ALONE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO EVENT SHALL TRIGUNATMIKA ATELIERR PVT. LTD., ITS DIRECTORS, EMPLOYEES, ARCHITECTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, OR INABILITY TO ACCESS OR USE, THE PLATFORM.

IN ALL CIRCUMSTANCES, OUR TOTAL AGGREGATE LIABILITY ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO TRIGUNATMIKA ATELIERR PVT. LTD. UNDER THE APPLICABLE ARCHITECTURAL PROJECT CONTRACT IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Trigunatmika Atelierr Pvt. Ltd., its directors, officers, employees, architects, consultants, and licensors from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of any provision of these Terms or applicable laws.
• Any content or photos uploaded by you that infringe the intellectual property or privacy rights of a third party.
• Unauthorized use of your login credentials or project activation codes.

These Terms and any dispute, controversy, or claim arising out of or related to your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute amicably through good-faith mutual discussions. If the dispute is not resolved within thirty (30) days, it shall be subject to the exclusive jurisdiction of the competent courts located in Udaipur, Rajasthan, India.

We reserve the right, at our sole discretion, to modify, amend, or replace these Terms at any time. When modifications occur, we will update the "Last Updated" date at the top of this document.

Material changes will be notified to users via in-app alert or official email notification prior to becoming effective. Your continued access to or use of the Platform following the effective date of revised Terms constitutes your full acceptance of the updated Terms.
